A family member was caught trespassing at a construction site in Richmond, VA, and received a summons. They claim there were no signs posted on the side of the building they entered. A Fairfax lawyer suggested that if the person who posted the signs (on the other side of the building) does not show up in court, the charges will be dropped based on a Virginia Supreme Court case. The lawyer costs $700 to pursue the case, and we are unsure if this is worth the cost or if we should hire a local lawyer instead. We are also concerned about the potential penalties of a trespassing misdemeanor (Class 1), which could include up to a year in jail and a $2500 fine. Should we hire the Fairfax lawyer, or is there a better option in the Richmond area?
