A person was pulled over for a DUI due to driving impairment caused by a migraine, exacerbated by Ambien. The blood draw was refused due to fear of needles, but a warrant was issued for the draw. The tox report indicated a 10mg Ambien, which was disclosed to the officer. The driver's license hearing is this week, and the DUI court date is next month. What charge can be pleaded down to that will allow the driver to keep their CDL?
