Can a condo board charge a $200 fine and make a resident pay for damages to a gate caused by their visitor or delivery driver, especially when residents are responsible for buzzing in visitors and educating them on how the gate works? Is there any way to protect oneself against this visitor liability, especially if the bylaws do not currently include this provision and residents are being asked to sign an agreement acknowledging this responsibility?

I want to file a motion to vacate in NH due to the discovery that the company suing my wife did not have a certificate of authority with the Secretary of State, which is required under RSA 293-A:15.02.
