If an employee embezzled money from an employer and they do not press charges, will it still go to court?

I found out that there is a case against me and my husband in the municipal court of San Diego, California, related to a financial obligation to an apartment leaser. I have an ongoing bankruptcy case under Chapter 13. What should I do next, and am I being charged an additional $59 for legal advice?

I hired a sign company to install vinyl lettering on a building. I paid them for half the job, but two days later, the lettering started coming off. They agreed to fix it but never did, so I fixed it myself. More lettering came off, and they again agreed to fix it but haven't shown up. My client is asking when it will be repaired, and I don't have an answer. I can repair it myself and be done with the sign company. Am I still responsible for the balance of the project if I'm the one doing the repairs? There was no contract signed, just a verbal agreement over the phone. I have no objection to paying them if they would do the repairs and give me a warranty in case any more lettering comes off in the near future, but they will not warrant their work. What should I do?
