I am short on time and less than 90 days from the trial date. I have two choices: filing a motion for summary judgment under Rule 12(b)(6) for failure to state a claim upon which relief can be granted, or filing a motion for judgment on the pleadings under Rule 12(c). I used the affirmative defense of failure to state a claim upon which relief can be granted in my answer to the complaint. I am the defendant in Arizona. What should I do?

I applied 2k earnest money on an offer to buy a 3 bedroom 2 bathroom home. The appraisal came back as a 2 bedroom 2 bathroom home. Based on this, my agent advised that the seller would sign a mutual release. Today, I received a letter stating that they are giving my earnest money to the seller based on 876 IAC 8-2-2. My agent advised me to seek legal advice. What should I do?
