I am trying to execute my deceased husband's will in Virginia. There is one property under his name, and he made a will to give it to my two sons. I believe it will go to probate, and I am an independent executor according to the will. Do I need a lawyer for probate? If there is a rental income from this property, does the executor get the income during probate processing, especially since the will states 'ALLOCATE BETWEEN PRINCIPAL AND INCOME: to make allocations of charges and credits as between principal and income as in the sole discretion of the executor or trustee may appear to be proper.'
