I defaulted on a car loan in April 2001, surrendered the car to the dealer, and now have a court date for later this month. The same company sued me in 2004 at small claims, which was dismissed, and now this is set for case management in civil court. Is that allowed, and should I get a lawyer? The total amount I am being sued for is $5,000 plus court and lawyer fees.
