I have a breach of contract action in progress that requires a declaratory judgment affirming the contract's validity. The defendant claims the contract is flawed due to a drafting error and has made a counterclaim for reformation. Since the two claims are inseparable and mutually exclusive, should a motion for summary judgment on the declaratory judgment claim be combined with a motion for summary judgment on the counterclaim for reformation? Or are these two separate motions?

I lost my car at the end of January. My insurance deemed it a total loss and paid off the majority of the car. I've been dealing with my auto lienholder, Bridgecrest, and Ally Gap Insurance to get them to pay off the rest of the car. Ally Gap Insurance finally sent the last check around May 11th, but Bridgecrest has yet to close my account due to their mistakes. Today, everything was supposed to be finalized, but they have pushed back my finalization date to the 16th. Do I have a case, and what steps should I take next?
