If an FMLA form is filed for a disability of which my doctor has written me to only work 10 hours a day, can my employer force me to file a claim with UNUM, therefore forcing me to use my disability? Can I be fired for filing FMLA? Can my employer fire me if I do not file a claim with UNUM? I live in VA. My workplace is a cabinet factory with over 250 employees, and I have been diagnosed with May Thurner's syndrome, a circulation problem, for which my doctor has provided a note stating I cannot work longer than 10 hours a day. I have not talked to a VA lawyer about the disability, and my employer forces us to work overtime of 12+ hours a day.

My wife works in California and was diagnosed with cancer. She is scheduled for surgery and plans to use SDI benefits for 4-6 weeks of absence. Her employer insists on referring to PFL benefits and requiring her to use all her PTO and sick pay first. We believe she should be able to use SDI without using PTO or sick pay. Are we correct, and what steps should we take to ensure she can use SDI benefits as intended?
