I have a rental debt being handled by a lawyer. I contacted them immediately upon receiving the letter and set up a payment plan. I also proposed a settlement offer of 50% of the debt, which has not been acknowledged by the lawyer or the rental company. The lawyer indicated they hadn't heard back from the client, but the client says they never received the settlement offer. What should I do at this point: keep inquiring, wait and see, rescind my offer and offer more, or lawyer up?

Can a collection process be pursued by a law firm when an individual is considered judgment proof when their expenses outnumber their total income? Additionally, can the defendant have a non-legal individual be with her during proceedings who is familiar with the dockets pertaining to a case of this nature?
