I have an opportunity to get into major retail stores with my product. Since Sub-Zero Candy Company is too close to Sub-Zero Freeze Dried Candy, would I be able to use the words Sub-Zero in my business name? Would Sub-Zero Freeze Dried Snacks work, or is that too close? What about Sub-Zero Snacks and leaving out freeze dried altogether? How likely is it that the other person could file a claim saying I'm infringing on their trademark, and how likely are they to win since we would fall under the same class? What would you recommend in terms of filing and appealing if necessary?
