I was in a bathroom at a local bar and saw a man picking up a bag of cocaine from a paper dispenser in the stall. I mistakenly assumed he was a regular patron and reached out to see what he had, but he was actually an off-duty narcotic officer. They assumed the cocaine was mine or placed there for me. I denied this and cooperated by giving my ID and number. Three days later, the officer called and asked to meet in a nearby parking lot, where he offered me the choice to either take a possession charge or become an informant. I haven't been arrested or charged yet. Can they still charge me with possession, and would such a charge stick in court for a small amount of cocaine, especially since I was never read my rights or placed under arrest at the scene?
