The charges were filed upon the inmate's release (3 months later). Is there an issue with the timing of the charges? Does there need to be an opportunity to perform the threat? How does 'intent' play a part in a terroristic threat charge? What issues or circumstances could void or weaken a terroristic threat charge? For example, threatening is common banter in the prison environment or guards have pointed laser pointers at inmates, etc.
