I sold a healthy horse to a couple on a payment plan. The buyer wrote a contract stating a $200 down payment and that the balance would be paid in full by April 1, 2012. However, the horse became severely malnourished, and the buyer returned the horse to me. I incurred significant vet and rehab bills. Can I sue the buyer in small claims court to recover the vet and rehab bills, the remaining contract amount ($1300), and the filing fees? Can I subpoena the text messages between us as evidence?
