I was involved in two car accidents within two weeks. In the first accident, my husband was at fault and I have $10,000 in medical coverage. In the second accident, the other driver was at fault, and I have $100,000 in uninsured motorist coverage and $10,000 in medical coverage. I received the maximum $15,000 from the at-fault driver's insurance (USAA) for the second accident. USAA now offers a settlement of $15,000 from the at-fault driver, $31,000 to cover my medical lien, and $55,000 to me, totaling $101,000. My medical lien is $31,000. Can I offset the first accident's $10,000 medical coverage towards the $31,000 medical lien? Should I accept the $55,000 settlement or is there potential to recover more, considering my $100,000 uninsured motorist coverage?
