What rights would I be giving up in special education mediation if I waive them under California Civil Code section 1542, especially if the information needed to make an informed decision wouldn't be available until after the fact? I am trying to make this difficult decision without knowing exactly what that is or what effect it would have if I made the wrong decision. Additionally, it is very important for me not to break confidentiality, so if this requested info or answer would create that, I'd like to skip it.

I need to know what kind of attorney to talk with and retain for a situation involving an HOA, where I have a basketball goal in my front yard that was approved by the HOA in 2005, but since then, the HOA has repeatedly levied fines against me for having it visible, despite my efforts to resolve the issue through communication and legal threats. The HOA has also denied me property rights and placed a lien on my property due to these fines. What kind of attorney should I consult for this ongoing dispute?
