I recently became handicapped and have a wheelchair in the back of my SUV. I live in a high-rise in Houston with designated parking spaces on the 4th floor, requiring me to use stairs to enter the building. The building also offers 24-hour valet parking. My issue is with the pet policy, which prohibits my 65 lb dog from stepping onto common areas, necessitating the use of a large pet stroller. Due to limited hand function, the stroller is cumbersome, especially with valet parking, as I have no place to store the stroller once my dog is in the car. I won a small claim judgment in 2011 by default as the defendant did not appear. The defendant later filed a motion to vacate the judgment claiming improper service. The judgment states that if not properly served, the defendant has 180 days from learning about the judgment to appeal it. The defendant learned about the judgment in February 2012, but the motion to vacate was filed in August 2013, exceeding the 180-day limit. Why did the court accept the defendant's motion to vacate?
