In a court case in Larimer County, Colorado, both the plaintiff (Borenstein & Associates representing Oliphant Financial LLC) and the defendant are ordered to attend a pre-trial conference and submit a Disclosure Statement prior to the conference. The defendant is gathering evidence to fight the claim and wants to know if both parties are required to submit the Disclosure Statement, and what the consequences are if one party fails to do so. Additionally, the defendant has read that if a debt collector fails to respond to a request for validation/verification of a debt, the debt becomes null and void under the FDCPA. The defendant seeks confirmation of this and clarification on the relevant part of the FDCPA.

In my state, fax filing is a legal form of service. The opposing attorney claims they did not receive the full fax and asked me to resubmit. I have the fax confirmation showing they received the full fax. I am worried that if I resubmit, they will claim I did not submit discovery soon enough. What evidence will hold up in court: my fax confirmation or their claim?

My son is starting a new business and needs cash. I want to give him a personal loan of $50,000 which he will begin repaying in January 2024. Can I do this without having any connection to his business? I don't want any connection to the business at all, and I own a home that I don't want jeopardized in any way if he should ever go bankrupt or be sued.

Me and my fiancé are getting married and hired a lawyer to draft a prenup for business separation. The lawyer has not completed the prenup with my fiancé's financial information after a month. Can we add his finances to the prenup ourselves and sign it to make it valid, or are there other steps involved, such as notarization or witnessing, to complete a prenup and make it valid in Arizona?

Is there such a thing as an illegal loan? I have a loan from my business that was originally for $17,000, with monthly payments of $1,400 for nearly 3 years, but I was recently informed that the loan term is 30 years. Where is this occurring, and what steps have you taken so far?
