In a motion to dismiss an appeal, the defendant/respondent stated in the notice of motion that the motion is based 'upon all of the pleadings and proceedings herein.' However, the defendant did not include all necessary pleadings and proceedings in the exhibits. Is this motion defective, and if so, what is the status of the incomplete motion in reference to other admissions made within that defective motion?

My mother recently passed away and my half-sister stole her legal documents and personal belongings, including jewelry, without authorization. I filed a police report and discovered an insurance policy in my name was assigned to a funeral funding company without my knowledge. The insurance company claims no fraud occurred as my signature was not forged and the claim has not been paid out. I believe the scheme to defraud was still in effect. What legal actions can I take against the insurance company and the funeral funding company for unauthorized access to my personal information?
