In an agreement, is indemnity limited under a liability limitation clause that states: 'Subject to clauses A and B, the Service Provider will indemnify the Customer against all kinds of actions, claims, demands, proceedings, liabilities, or expenses (including all legal and other fees and disbursements) resulting from any third-party claim, suit, action or proceeding to the extent arising out of or relating to Service Provider’s breach of this Agreement except to the extent such claim arises out of Customer’s gross negligence, wilful misconduct, or breach of this Agreement.'?
