My daughter's catalytic converter was stolen while it was parked in a repair shop parking lot waiting to be fixed. The shop owner says he is not liable for the cost to replace it since it was outside in his lot and not inside. Is he correct? I am concerned about the Indemnification; Insurance clause in a lease I am supposed to sign in New Jersey, particularly section (A), which seems to remove any liability from the landlord for damages that he could reasonably be held liable for in court. I am worried that this clause contains illegal language and whether it would hold up in court if I were to sign it. Additionally, I am unsure if I can negotiate this clause or if signing it would still be valid in court, given that the landlord is required to keep the property in repair.
