I have been harassed for a year about a small construction site in Brooklyn, with the harasser using 311 to make false complaints (120 false complaints). I have done a FOIL request but they refuse to give me full records. The police are slow to file as they say there are too many moving parts and it's not 1st-degree harassment. HPD, which received most complaints, refuses to flag the building though they know nobody lives there. The harasser pretends to be a tenant, but I have no tenants. I have called public advocate, council member, precinct, HPD, and DOB investigation units, and sent letters to HPD and DOB representatives. Could I sue successfully 311 for no due process guaranteed by the 14th amendment? What other grounds can I sue for?
