I have been hired by a company as the Head of Program Management, then VP of Program Management, and then Sr. Exec. VP of Program Management (all in less than 4 months). Initially hired at will, I negotiated my employment to be at cause under specific circumstances: 1) I planned to invest $250k in the company (convertible note at 8%), but instead, I lent the $250k for 6 months to fund an acquisition. 2) The loan agreement included a severance package of 6 months' pay if my employment ended before the loan was repaid. 3) After the 6 months, the severance package would disappear. 4) The loan was supposed to convert into a convertible note if I chose to do so. 5) I negotiated a contract at cause to protect my investment, better salary, and a better title/position. 6) The $250k was used to acquire another company, saving it from bankruptcy. 7) Since the acquisition, the work environment has become toxic with harassment and discrimination. 8) The acquired company's senior management lobbied to push me out, which happened in February. 9) I notified my management about the toxic environment and aggressive behavior, but they ignored my concerns. 10) I felt compelled to leave due to the intolerable work environment. 11) I am still at work trying to negotiate my exit without losing my investment and severance package. 12) My manager told me that if I request my severance package, I would be asked to leave immediately. 13) The company is trying to keep me until the loan matures to avoid paying the severance. 14) I feel this is unfair as the company used my money for an acquisition that increased its value. 15) Promises were made but not kept, and the final agreement was never provided. 16) I could potentially lose a significant amount of money if I leave. I need to speak to a Florida attorney who specializes in consumer debt protection law (but not consumer bankruptcy law). We are from Louisiana and have been in Florida for about 1.5 years and have some legal questions to ask. Specifically, I was recently sued by American Express for an unpaid credit card debt and received a summary judgment against me. My questions are: 1) Can they pursue garnishment of my wages without notice, or does there need to be another hearing to start garnishment? 2) If I qualify as head of household, do I need to file an exemption form for every suit? 3) Can I file the exemption form from Marion County where I now live, or does it have to be filed in Okaloosa County where the judgment was rendered? 4) If my husband is on SSDI and I clear about $1800.00 per month, would I qualify for the head of household exemption? 5) Because of my job, Chapter 7 is not an option. Are there any other tools or options to prevent garnishment besides filing head of household exemptions? 6) Once a judgment is rendered, can a creditor file for seizure of non-exempt property if they cannot garnish my wages? 7) My husband and I have a Louisiana prenuptial agreement in place for the last 10 years. He owns a 5th wheel solely in his name which we have been living in for the last 2 years. He filed a statutory designation and declaration of homestead and declaration of domicile on the RV. Are we protected against seizure of what is now our home?
