My boss hired an old friend who is now my direct report, despite the friend being less qualified than other candidates. There have been multiple performance issues and complaints of inappropriate sexual comments from the friend, which my boss has ignored. HR attempted to intervene, but my boss instructed me to manage through the issues until the one-year mark. Now, my director plans to remove the friend as my direct report and conduct the annual review himself to avoid another poor review and reduce the chance of HR insisting on a performance improvement plan. Is this illegal, and do I have legal rights in this situation?

I received a judgment on a husband and wife that did not pay their rent. The judgment was from 1/9/04 for $9,500. Can I still file for 'Application and order for appearance and examination' to get them back into court? I have the form and it appears to require a date to be set by the court for the hearing before I serve them with the notice. Unfortunately I am in Missouri now. Can it be done by mail through the court?

Our Association is in the process of choosing a new property management company. The Board of Directors (BOD) selected one company based on presentations and interviews, but the contract presented by the company significantly differed from their initial presentation, with a clause stating: 'This Agreement constitutes the full understanding of the parties and no prior or contemporaneous oral or written representations made by either party shall be binding upon other.' Could this contract be approved without a second vote of the BOD?

In a personal injury lawsuit, can I itemize a request for punitive damages in my response to a request for a statement of damages, even though the current cause of action is only for general and special damages, and the potential for fraud (related to the defendant altering a surveillance tape) has not yet been pleaded?
