My sister passed away on June 12 and did not mention leaving her home to her brother in her will until after she died. Both were over 60 years old. Her son initially thought he was the executor and set up a rent account at the bank. The family knew about the arrangement for the brother to stay in the home. The sister tried to give the house to the brother but he declined at the time. Now, the sister's daughter is evicting him. The will seems incomplete, missing pages, no lawyer signature, only 2 witnesses, and not notarized. The brother has until 10/31 to contest the eviction, but the sheriff's deadline to evict is 10/12, and the court date is 10/14. Is there any legal basis for the brother to remain in the home? Will contesting the will freeze the eviction? The sister's two other children didn't know their sister would evict the brother and had no idea about this.
