We are a small business providing IT services, including HIPAA email, cloud backup of files on computers, MS updates, and virus protection. A former customer discontinued using our service and requested backup data after the end date. We refused unless they paid a fee as there was no active contract. They are now suing for the data. What is the nature of the service we provided, and does our agreement allow us to keep that data at the end of the service agreement?
