Who does the Notice go to, the Court or the Defendant or both? What does it mean by "Any facts that you cite in your points and authorities must be introduced through your declaration?" Is the declaration like an outline of your memorandum, except that you are submitting it under the penalty of perjury? Do these procedures apply to County Court, District Court, or both? We are in County court. And, does it apply to Colorado rules and procedures?

I am being sued in small claims court in California because my dog bit another dog at a dog park. The other dog was a three-legged dog on chemotherapy. Initially, the other owner declined to exchange information and later demanded $300, which I agreed to pay in installments due to my unemployment. He is now suing me for the vet bill plus $1,000 for pain and suffering. My dog had never come into contact with a small dog before, and I mentioned that my dog doesn't like small dogs. I found out about the case through mail from a TV show and later through the superior court website. I was not properly served, and the other owner refused my offer of compensation. Is his $1,000 claim valid, and does this case belong in court?
