Can Just Answer recommend a divorce attorney with extensive experience in Dekalb County Georgia? If I file for my complaint for divorce based on only irretrievably broken, even though cruel treatment and adultery are also grounds, can I go back and change my reasons once my wife files a response? Hi Mary, you just answered my question, but I still need clarification on the 72-hour hold. If you read my question to Paul about an involuntary commitment in Nebraska where I got relief from a firearms disability that lifted the commitment, and Paul said in his answer that I do not have to answer the question of commitment to a mental hospital, I also thought a voluntary commitment or voluntary admission for treatment was not the same as an involuntary commitment. Do I need to answer?

I had a government deposit into my credit union account, and the credit union took over $9,000 of the funds for a vehicle I had gap insurance on that was totaled. My insurance paid a portion, and I didn't know I had a balance left that was owed after almost two years until they took the balance of the vehicle out of my account. What prompted the 4/14 conversation was that I found out about the balance last week when my account was debited. I called to find out why my account was debited and that's when I found out that a gap claim was never processed after they received the insurance money from Geico. The balance was deducted from my 2020 income tax that went into my account that I had been waiting for for 14 months. On 4/14, I called spoke with the rep who debited my account; she was nice enough to return most of the funds except almost $3,000 while I called gap. I called gap because the 3 days passed and I had never received the promissory note they were supposed to email me for me to sign. However, because I didn't get the email, I called about it today; they told me to go to a branch instead. I checked my account; they had taken the remaining amount back out today, and the last person who was helping me prior told me she saw where they had just placed notes on my account that they were not going to pay my gap claim. Do I still have my documents for the purchase of the vehicle? Are you asking about when I applied for the loan? Because I was approved via their mobile app. I never physically filled out any paperwork with the credit union. They sent a check that was signed over to the dealership. When I purchased the vehicle minus the cash I put down on the vehicle. This is a little concerning. If you didn't sign a promissory note, then there's a question about the authority that they are using to take the money. It sounds like there must be some authority in the electronic application documents. I said the same thing; however, when they advised they couldn't process my gap claim without having a signed promissory note but can debit my account without having one, I was thrown off by that. Then they stalled in my opinion because they put off on debiting the amount they gave me back on the 14th to allow time for the processing of the gap claim and to get all needed paperwork in. However, I spoke to that department 2x today but was advised by a different department that they had declined my claim. You may also want to review your credit union account agreement. It may also give them authority to debit your account for amounts owed. That agreement should have language that discusses the circumstances under which that can happen. If there is no such language, it may be time for you to consider filing a complaint with your state's consumer protection office and have them investigate what's going on here. Thanks, I will. They offered me a settlement amount which was $3,000; however, when they advised me that no gap claim had been filed, I decided to contact the gap department. However, today when they declined and debited my account, that settlement amount was no longer on the table; it's as if they stalled just to get the most money they stated I owed.
