I have questions about filing as an injured spouse. My entire 2017 tax return was taken due to a debt my spouse owed. The form 8379 is confusing, particularly section 1 part 9, which asks if I'm receiving a tax credit. If I check 'no', it says I shouldn't file the form. I was due an overpayment refund of over $6000, but my spouse's ex filed to collect money through a court. How should I proceed with filing Form 8379?

Am I classified as a non-resident alien (NRA) for tax purposes? I am on an O1 visa and have been in and out of the U.S. over the past few years. My payroll company is currently taxing me as an NRA, but I believe I should be classified as a resident alien.
