I left the USA in 2000 and returned to New Zealand. Upon returning to the USA in 2005, I discovered the IRS had filed a fraudulent tax return for me in 2000, resulting in a $14,000 tax liability. After ten years of dispute, the IRS admitted their error and stated they owe me $9,856. However, they refuse to pay this refund, citing the three-year deadline for claiming refunds has passed. Given that the IRS filed the return fraudulently and I only learned of it recently, should the 'claim clock' start from when I discovered the error, and is there any way to recover the owed refund and compensation for the damages caused by their actions?

My brother and his girlfriend have lived together for 14 years and have a 13-year-old daughter. My brother files as head of household and claims their daughter as a dependent. His girlfriend files single and makes about $11K/year. Can she claim the earned income credit even though my brother claims their daughter on his taxes?

I am using TurboTax for the web. My wife received a payment for bonus and travel expenses from a state-run (Florida) organization that is not her employer related to educational courses she took during 2007. She received a 1099-MISC with the amount in Box 7. How do I report this since she is not an employee of the company that sent her the money nor is she self-employed? TurboTax requires me to enter one of several options that do not apply to her situation, such as filing an SS-8 or indicating she is an employee. How should I report the income?

If I made 17,500 this year from a divorce agreement under distribution of assets, do I need to pay taxes? I am 33 years old, recently divorced with a 6-year-old dependent, and believe I would file as head of household. The payments are not under alimony or child support, and we have joint custody of our child. Who claims her as a deduction?
