I'm filling out Form 7004 and need to determine if my LLC qualifies as a partnership under Regulations section 1.6081-5. The LLC is formed in Delaware but conducts all business and keeps its books outside the US. Additionally, last year we received a penalty for late filing of Form 1065, which we filed despite having no income or expenses. What should I do to avoid penalties and correctly file this year?

My daughter received an SSA-1099 for her social security survivor and disability benefits from her mother's death. I am the overseer on the account. Do I or does she need to pay taxes on that money? Box 5 is $132,126. I am a painting contractor, have my daughter as a dependent, and we live in California.

Our employer contributed $600 to our HSA in 2023, but we later realized we were ineligible due to Medicaid. We corrected the contributions and withdrawals with correction forms. What are the tax implications and procedures for filing once we receive the refund, and what are the tax implications of the employer's donation? We haven't filed our taxes yet, so our portion shouldn't have an excise tax, but we're unsure of the employer's donation tax implications and how they might report it on the W-2. Do we need to get the employer to fix it, or is it their responsibility?

TP is a very minor, less than 1% limited partner in a domestic partnership which is a foreign partnership. In 2019, he contributed more than $100,000, potentially triggering an 8865 Category 3 filing requirement. The IRS instructions state that if a domestic partnership contributes property to a foreign partnership, the domestic partnership's partners are considered to have transferred a proportionate share of the contributed property to the foreign partnership. However, if the domestic partnership files Form 8865 and properly reports all the required information with respect to the contribution, its partners will not be required to report the transfer. There is no way to confirm if the domestic partnership has filed and reported all required information. Is the most conservative approach to prepare the 8865 as a Category 3 filer, or is there a further exception for a less than 10% partner despite a contribution of more than $100,000?
