My husband and I hired a nanny for 16 weeks last year and were told we would just file a 1099 for her taxes. Now we realize this is illegal and she should have been issued a W-2. We did not withhold any taxes from her paychecks. Do we or the nanny have to pay back the taxes that weren't previously taken out?
