I prepaid $35,000 in 2000 and didn't file tax returns from 1998 to 2003. I filed all returns in March 2004, owe nothing, and the IRS won't return the $35,000 because I didn't file the 2000 return on time. Is there any way to get the $35,000 back?

If I fill out the Dependent Tax Affidavit for Domestic Partnership Insurance for TWU Local-100, does this mean that my partner has to claim me on his taxes under IRS Code rule 152? We live together, have a child together, and I have a full-time job. Am I correct in understanding that under IRS Section 152, I am an individual who for the taxable year of the taxpayer, has as my principal place of abode the home of the taxpayer and is a member of the taxpayer's home? Would I still qualify to be under his Domestic Partner Health Care?
