If I incorporate my LLC as an S corporation now, do I need to operate as an LLC for the first few months of the next year before switching to S corporation status?

I filed jointly for the tax year of 2019 while in the midst of a divorce. My STBX owns a partnership interest in several businesses, and we used the same accountant who filed our taxes for the past 15-20 years. The accountant informed us that we both need to agree to ask for a refund of the overpayment in taxes, but my STBX refused. As a result, I ended up filing jointly and paid over $30k in taxes due to his business income. Am I entitled to receive the money I paid for his companies' taxes back as part of a divorce settlement?

Why haven't I received my $600 or $1400 stimulus checks? I am 76 years old, live on Social Security and a small retirement, and have not filed taxes for years because I do not make enough money. I received my $1200 stimulus check without any problem.
