My daughter has 2 children and is collecting SSI. She lives with the children's father, who has never claimed her when filing taxes. They are not married, and he doesn't contribute much to household expenses. He owes child support from a previous marriage and changes jobs frequently. Last year, he filed taxes with only one child from my daughter, and the IRS applied his refund towards his back child support. My daughter wants to leave this relationship but needs the income from the tax return to set up a home for her children. She did not work or go to school last year and cannot receive the refund. Can I (the maternal grandmother and my husband) file and claim the children legally?
