My partner was out of work for a while and I had to withdraw from my 401k, incurring a 10% penalty and additional federal taxes. I am in a civil union and my partner has filed her taxes already. She is covered under my health insurance at work. Would I claim her as a dependent, and what goes into being exempt from the extra 10% penalty?
