I own a rental property with my (still) husband, but he has been awarded 100% control and management by a court order. I have not received any profits from the property for years. He was recently awarded all the accrued income to pay for his tax attorney, totaling over $75k. Since there is a court order and he has received all the income, do I have to file itemized deductions on my tax return when I have not benefited or been a part of the property for years? Why should I have to file 50% community income/debts when I've not been a part?
