Regarding Internal Revenue Code Section 196(b), if an individual taxpayer dies and there are unused credits from qualified business credits, can these credits be claimed as a deduction instead of a credit on the joint tax return, and if so, how should they be allocated between the surviving spouse and the deceased?

I am the legal guardian (custodial parent) of my daughter and son. My children's father and I live together and are both eligible to claim the children. I agreed to let him claim the children. If he does not claim the earned income credit for the kids, can I claim the earned income credit even though he is going to claim the kids as dependents, get the child dependent care credit, child tax credit, and additional child tax credit, and file as head of household? We were never married.

My husband and I are trying to file married separate returns. He lived 8.5 months in CA and then moved to MA to work. I work and live in VA with our kids. VA is our home and is where we own a house. Since he is a part-year resident of CA, shall we consider our combined incomes on his tax form? What about mine? My state is not a community state, can I only declare my income on my federal tax form? Thanks.
