A Board VP of our HOA took it upon himself to repair the tennis courts without discussion or approval from other Board members, resulting in damage that requires resurfacing. Can he be held liable for damaging the Common Property as written in the Declaration? Additionally, if other Board members decided as a majority without involving me as a Board member, can they be held liable for the pending repairs because they were acting in bad faith by trying to cover up the fact that they already paid the initial contractor in full that they hired, but are no longer in business?

Franklin Carreno was representing Victor Brown, a Diplomat from Bahrain, who was delivering a diplomatic parcel at the Air National Guard Base in Knoxville, Tennessee. Victor Brown had a stroke and received medical care there. When asked to help pay his medical bills, Franklin Carreno asked to be paid $500,000.00, later negotiating to $250,000.00. On the day he was supposed to pay the medical bill, he called the base and disclosed the parcel he believed was of monetary value.
