Do I need to be under a doctor's supervision, or can I operate independently with malpractice insurance and within my scope of practice?

If a plaintiff, who is suing pro se, files a lawsuit against their former employer for discrimination under Title VII and fails to prevail in court, does the plaintiff have to pay the defendant's legal fees? If so, who decides this, and will the defendant need to file a separate lawsuit to recover these fees?
