In a court case in Larimer County, Colorado, both the plaintiff (Borenstein & Associates representing Oliphant Financial LLC) and the defendant are ordered to attend a pre-trial conference and submit a Disclosure Statement prior to the conference. The defendant is gathering evidence to fight the claim and wants to know if both parties are required to submit the Disclosure Statement, and what the consequences are if one party fails to do so. Additionally, the defendant has read that if a debt collector fails to respond to a request for validation/verification of a debt, the debt becomes null and void under the FDCPA. My son is starting a new business and needs cash. I want to give him a personal loan of $50,000 which he will begin repaying in January 2024. Can I do this without having any connection to his business? I don't want any connection to the business at all, and I own a home that I don't want jeopardized in any way if he should ever go bankrupt or be sued.
