I co-signed for an auto loan for my daughter's fiancé. They are now not together. If I pay off the balance and draw up legal paperwork for a repayment schedule, will that loan come off my credit? Additionally, if we pay off the loan to protect us from litigation if he were to wreck the truck, should we put it in his name or ours? If we become the loan company by paying off the current loan and having him sign a promissory note in front of a notary, and I write on this note that if he misses 2 or more payments he will be considered in default of this loan and we will take possession of the truck, is this legally binding and can we do this?
