Good Morning Ray, the response for the defenses' motion to dismiss is taking time, but I have completed 6 pages and wanted to make sure I was on the right track. I will be preparing a cover letter to the court and its officers for not filing a reply. In reading the one defense attorney's Motion, he seems very upset, so he attacks the complaint, since he knows he is unable to prove removal was warranted. I guess we will find out. They are embracing some of the rulings of the 5th Circuit, however they effectively have created two instruments by which a borrower could be foreclosed on...one by the Deed of Trust and the other by the Promissory Note, when the US Supreme already ruled and the 5th Circuit concurred that if they were separated the Deed would be a nullity....why is the 5th Circuit ruling like this, could they have been misinformed?

My relative sued in a wrongful case suit for my father. The relative was awarded a portion for her in pain and suffering with the suit. My sister and I, as his heirs, contacted a probate attorney appointed by the court who had no knowledge of us as heirs in the remaining estate, only knew of the relative. The attorney assured us that there has been no money in a payout of any kind yet as the case was won but now is back in litigation. Is there a need for our own attorney now in a case that may or may not be for any filing of any kind yet with what all could be at stake? Don't want to make a big mistake!
