I'm looking for guidance on whether I can assign the grievances we have against a company who has sued us for breach of contract, for which we filed a counterclaim. Our issues with them are classifiable under a return breach of the contract, implied and or specific, as they did not do what they were hired to do, damaged real property, trespassed, and ultimately have not provided an invoice, any attempt at collections, or even a late notice for an invoice, for which they're basing their suit against us on (our BOC - non-payment). URGENT! I received an email from Joe's lawyer stating I can pick up all her exhibits and evidence against me today or in the morning. I have two main concerns: 1) What immediate actions should I take given the late delivery of these documents? 2) Does picking up the evidence imply agreement to her submitting it in court? Additionally, I discovered she subpoenaed one of my kids' teachers without proper notice, filed it late, and did not provide a witness list.
