I am currently the defendant in a breach of contract case in the Alexandria VA circuit court. The plaintiff is alleging anticipatory breach, claiming I breached the contract by stating my intention to litigate his fees. I have never missed a payment and did not intend to stop paying until reviewed by an authoritative body. The amount in dispute is $98,000. I recently learned the plaintiff is a resident of the District of Columbia, while I am a resident of Virginia. Can I move this case to Federal court under the principal of diversity jurisdiction, how would I do that, and is there any benefit in moving this case to a federal court?
