I am going through a divorce in Charlotte, NC. The judge has put an injunction on me, stating I cannot spend any more marital funds or face jail time. I cashed in a $6,780 homeowners insurance check written to me and my wife after the injunction was put into place, for replacing the roof on the marital residence. My ex-wife lives separately and has stated she doesn't want anything to do with the insurance check if it's not used to replace the roof. Can I spend the $6,780 on whatever I want, or am I putting myself at risk of jail time? Additionally, when I cashed in my 401K, I sent $60K to the IRS to pay taxes. Can I file my taxes and move forward without risking jail time, and is there any way the NC Family Court can get the money back from the IRS?
