I am the plaintiff in an unlawful detainer case. The defendant served me a motion to strike with a court date for December 20th. I also filed for a court date but did not yet receive an answer. What are my next steps? How should I respond to the motion to strike, which argues that I don't have capacity to sue? Will this motion prevent the court date I requested from being delayed until the 20th?

If my witness (animal necropsy doctor) is asking me to send him a subpoena for deposition and cc'ing my defendant to this email, is it okay?
