I appealed an order in family court where my former family law attorney sought fees against me based on the result of a review from the Florida Bar. I believe the venue should have been civil court. My current family law attorney couldn't represent me because he said this was a contract dispute and outside his scope and expertise. Civil/contract law attorneys said they don't handle cases in family court. What can I state on my appeal regarding the selection of venue? The judge himself wasn't even sure he was the right judge to make the ruling - he voiced that directly during the hearing, but then issued an order regardless. I don't want to pay him at this time because I am still going through a grievance proceeding against him for failing to file documents as promised and failing to show for hearings.
