If I have lived with my boyfriend for a couple of years in California, and then we move to Texas and want to be in a common law marriage, would we be able to right away considering we have already been living together for more than 2 years? Or do we need to live in Texas specifically for a span of time before we can agree to a common law marriage?

I was charged with a code (16-3-20 assault by mob) that was deemed unconstitutional 6 years before my charge. I pleaded guilty under duress, and I believe my case should be thrown out due to the unconstitutional nature of the code. Additionally, the arrest warrant my lawyer received is different from the one I gave him, suggesting possible tampering. How can I challenge my conviction and find the original warrant to prove tampering?
