I have a civil case where the defendant's lawyer has contacted me twice to discuss a settlement before our trial on Thursday. I'm uncomfortable talking to him and want to know if anything I say could be used against me in court. Additionally, the judge granted a default on the defendant's counterclaim, and I'm unsure how this affects my initial lawsuit. Should I respond to the lawyer's settlement inquiries, and if so, how should I proceed?
